चुनावी गणित का एक और खेल, अब बिहार में 75 फीसदी आरक्षण
बिहार सरकार ने जातिगत आरक्षण का दायरा बढ़ाकर 65% करने और आरक्षण 75 फीसदी तक करने का मन बना लिया है ।
विधानसभा से आरक्षण संशोधन विधेयक 2023 पास हो गया। गौरतलब है की जदयू राजद और कांग्रेस की महागठबंधन की सरकार के इस मुहीम का किसी भी राजनितिक दल ने विरोध नहीं किया। इसके फलस्वरूप बिहार में अब अनारक्षित कोटा मात्र 25% ही बच गया है। विधान सभा के शीतकालीन सत्र के चौथे दिन आरक्षण संशोधन विधेयक पारित हो गया जिससे बिहार राज्य में 75 फीसदी रिजर्वेशन लागू करने का रास्ता साफ हो गया।
बिहार विधानसभा में आरक्षण संशोधन विधेयक- 2023 पेश किया गया था। इसमें सरकारी सेवाओं में अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों के लिए 15 प्रतिशत अतिरिक्त आरक्षण दिए जाने की व्यवस्था है। सदनों से पारित होने के बाद ये विधेयक स्वीकृति के लिए राज्यपाल को भेजा जाएगा। मुख्यमंत्री नीतीश कुमार ने जाति आधारित सर्वेक्षण रिपोर्ट आने के बाद रिजर्वेशन का दायरा बढ़ाए जाने की घोषणा की थी। इसके बाद कैबिनेट ने भी इस प्रस्ताव पर मुहर लगा दी थी।
दरअसल, बिहार विधानमंडल में जाति सर्वेक्षण रिपोर्ट पेश करने के कुछ घंटों बाद मुख्यमंत्री नीतीश कुमार ने कैबिनेट की बैठक की। इसमें पिछड़ा वर्ग, अत्यंत पिछड़ा वर्ग और आर्थिक रूप से कमजोर वर्ग (ईडब्ल्यूएस) के लिए राज्य में आरक्षण 75 प्रतिशत तक बढ़ाने का प्रस्ताव पारित कर दिया। इसके बाद इसे सदन से भी पारित करा लिया गया।
राज्य में 2019 में 103वें संविधान संशोधन के तहत आर्थिक रूप से कमजोर सवर्णों (EWS) के लिए 10 प्रतिशत आरक्षण के बाद पहले से ही सुप्रीम कोर्ट की तरफ से तय की गई अधिकतम 50 प्रतिशत कोटा की सीमा पार हो चुकी थी। देश के उचत्तम न्यायालय ने ‘इंदिरा साहनी और अन्य बनाम भारत सरकार, 1992’ केस में ऐतिहासिक फैसला सुनाया था। 9 जजों की संविधान पीठ ने 6-3 के बहुमत से जाति-आधारित आरक्षण की अधिकतम सीमा की लकीर खींच दी जो 50 प्रतिशत से ज्यादा नहीं हो सकता।
अनुसूचित जाति और अनुसूचित जनजाति (एससी-एसटी), साथ ही अन्य पिछड़ा वर्ग और अत्यंत पिछड़ा वर्ग के लिए आरक्षण को सुप्रीम कोर्ट के निर्धारित 50 प्रतिशत की सीमा से बढ़ाकर 65 प्रतिशत करने का प्रस्ताव सदन से पारित कर दिया गया।
मुख्यमंत्री नीतीश कुमार ने प्रस्ताव रखा कि दोनों समुदायों को एक साथ 43 प्रतिशत आरक्षण मिलना चाहिए। इन बढ़ोतरी में आर्थिक रूप से कमजोर वर्ग के लिए 10 प्रतिशत आरक्षण शामिल नहीं है। ईडब्ल्यूएस कोटा के साथ बिहार में आरक्षण 75 प्रतिशत तक बढ़ जाएगा।
खास बात ये है की ,2024 के आगामी लोक सभा चुनाव में मद्देनज़र जातिगत और आरक्षण जैसे मुद्दों को बिहार सरकार अपने वोट बैंक की राजनीती साधने के मनसूबे को जाहिर कर दिया है, जबकि पुरे राज्य का विकास अब बैक सीट पर पहुँच गया है , अब २०२४ के लोक सभा चुनाव के बाद ही ये तय होगा की इन मुद्दों से महागठबंधन की सरकार को क्या और कितना फायदा मिलेगा।
