केंद्र सरकार के अनुच्छेद 370 को हटाए जाने के पक्ष में सर्वोच्च न्यायालय की लगी मुहर
सुप्रीम कोर्ट ने संविधान में अनुच्छेद 370 को निरस्त करने के केंद्र सरकार के आदेश को बरकरार रखा, धारा ३७० को हटाए जाने पर सर्वोच्च न्यायालय की लगी मुहर । सीजेआई चंद्रचूड़ ने कहा कि, “राष्ट्रपति केंद्र की सहमति से संविधान के सभी प्रावधानों को जम्मू-कश्मीर में लागू कर सकते थे और इसके लिए राज्य विधानसभा की सहमति लेने की भी आवश्यकता नहीं थी। चीफ जस्टिस डीवाई चंद्रचूड़ समेत बेंच में जस्टिस संजय किशन कौल, जस्टिस संजीव खन्ना, जस्टिस बी आर गवई और जस्टिस सूर्यकांत भी थे I
जम्मू-कश्मीर से आर्टिकल 370 हटाए जाने के केंद्र के फैसले को सुप्रीम कोर्ट के संविधान पीठ ने सही ठहराते हुए फैसला दिया कि जम्मू-कश्मीर में केंद्र सरकार द्वारा 2019 को लिए गया फैसला सही था और यह बरकरार रहेगा । सीजेआई ने आगे कहा कि, केंद्र राष्ट्रपति की भूमिका के तहत राज्य सरकार की पावर का उपयोग कर सकता है। कोर्ट का मानना है कि अुनच्छेद 356 के तहत राष्ट्रपति शासन लगाने के बाद प्रयोग की जाने वाली शक्तियों पर प्रतिबंध हैं।
सुप्रीम कोर्ट द्वारा जम्मू-कश्मीर से आर्टिकल-370 हटाए जाने के फैसले को सही ठहराए जाने के बाद अब इसे लेकर राजनीति भी तेज हो गई है. गुलाम नबी आजाद ने सुप्रीम कोर्ट के फैसले को ‘‘दुखद और दुर्भाग्यपूर्ण’’ करार दिया I संसद के शीतकालीन सत्र के दौरान भी इसका असर साफ देखने को मिला. विपक्ष ने राज्यसभा में सुप्रीम कोर्ट के फैसले को लेकर हंगामा किया. वहीं, सत्ता पक्ष की तरफ से पीयूष गोयल ने विपक्षी नेताओं को इसका जवाब दिया.
आर्टिकल 370 काफी पहले ही लागू हो गया था और इसके लागू होने के चार साल बाद, सुप्रीम कोर्ट ने सोमवार को यानी आज 11 दिसंबर को जम्मू-कश्मीर में संविधान के अनुच्छेद 370 को निरस्त करने को चुनौती देने वाली याचिकाओं पर सुनवाई की। भारत के मुख्य न्यायाधीश की अध्यक्षता में पांच न्यायाधीशों की संविधान पीठ डीवाई चंद्रचूड़ फैसला सुनाया।
आर्टिकल 370 को निरस्त करने के बाद कोर्ट ने भारत के चुनाव आयोग को सितंबर 2024 तक जम्मू-कश्मीर में चुनाव कराने के निर्देश दिये हैं। अनुच्छेद 370 मामले में सुप्रीम कोर्ट ने कहा, “अनुच्छेद 370 जम्मू-कश्मीर के संघ के साथ संवैधानिक एकीकरण के लिए था और यह विघटन के लिए नहीं था, और राष्ट्रपति घोषणा कर सकते हैं कि अनुच्छेद 370 का अस्तित्व समाप्त हो गया है।”
