डिजिटल व्यक्तिगत डेटा संरक्षण (डीपीडीपी) नियम एक महीने के भीतर प्रकाशित किए जाएंगे
नई दिल्ली: केंद्रीय आईटी मंत्री अश्विनी वैष्णव ने घोषणा की कि डिजिटल पर्सनल डेटा प्रोटेक्शन (डीपीडीपी) नियमों का एक मसौदा अगले 30 दिनों के भीतर सार्वजनिक परामर्श के लिए प्रकाशित किया जाएगा। यह मसौदा डिजिटल व्यक्तिगत डेटा संरक्षण अधिनियम, 2023 के कार्यान्वयन के लिए आवश्यक है, जिसे अगस्त 2023 में कानून में हस्ताक्षरित किया गया था। आगामी नियम डेटा संरक्षण बोर्ड के लिए परिचालन ढांचे की रूपरेखा तैयार करेंगे, जो डीपीडीपी अधिनियम के तहत स्थापित एक प्रमुख निकाय है। पूरी तरह से डिजिटल तरीके से व्यक्तिगत डेटा का उल्लंघन।
वैष्णव ने कहा कि डेटा प्रोटेक्शन बोर्ड के लिए डिजिटल ढांचे को सावधानीपूर्वक डिजाइन किया गया है, जिसमें मामले से निपटने से लेकर अपील तक इसके संचालन के सभी पहलुओं को शामिल किया गया है। सरकार की योजना मसौदे पर सार्वजनिक प्रतिक्रिया के लिए कम से कम 60 दिनों का समय देने की है, जो 45 दिनों की सामान्य न्यूनतम परामर्श अवधि से अधिक है।
डीपीडीपी अधिनियम की एक महत्वपूर्ण विशेषता डेटा संरक्षण बोर्ड और एक अपीलीय न्यायाधिकरण के लिए एक “डिजिटल कार्यालय” की स्थापना है। अपीलीय न्यायाधिकरण बोर्ड के निर्णयों से असंतुष्ट व्यक्तियों को सहारा प्रदान करेगा। डेटा प्रोटेक्शन बोर्ड के लिए डिजिटल प्लेटफॉर्म इलेक्ट्रॉनिक्स और सूचना प्रौद्योगिकी मंत्रालय (MeitY) द्वारा राष्ट्रीय सूचना केंद्र और डिजिटल इंडिया कॉर्पोरेशन के सहयोग से विकसित किया जा रहा है। इस प्लेटफॉर्म का अभी परीक्षण चल रहा है और नियमों को अंतिम रूप दिए जाने के बाद इसे लॉन्च किया जाएगा।
जुलाई में, वित्तीय वर्ष 2025 के लिए डेटा प्रोटेक्शन बोर्ड की स्थापना और वेतन खर्चों को कवर करने के लिए MeitY को ₹2 करोड़ का फंड आवंटित किया गया था, अधिनियम के पूरी तरह से लागू होने के कारण फंडिंग में बढ़ोतरी की उम्मीद है।
वैष्णव ने बच्चों के डेटा के प्रसंस्करण के संबंध में चिंताओं को भी संबोधित किया, जो डीपीडीपी नियमों में एक जटिल मुद्दा है। उन्होंने संकेत दिया कि सरकार ने इस मुद्दे को सुलझा लिया है और मसौदा नियमों के जारी होने पर विवरण का खुलासा किया जाएगा। सरकार इसमें शामिल तकनीकी चुनौतियों को स्वीकार करते हुए, नाबालिगों के लिए माता-पिता की सहमति को सत्यापित करने के लिए डेटा फिड्यूशियरीज के लिए एक विशिष्ट तंत्र निर्धारित करने की योजना नहीं बना रही है। उम्मीद है कि मसौदा नियमों से इन और डीपीडीपी अधिनियम के अन्य महत्वपूर्ण पहलुओं पर स्पष्टता मिलेगी।
